Agreement to Terms
By accessing or using MAGENTA ("the Service"), operated by Comma Connect, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.
1. Service Description
MAGENTA is a federated community platform providing:
- QR code generation with P3 color space support
- Smart link management and NFC integration
- Privacy-focused analytics infrastructure
- Workflow automation and webhook orchestration
- First-party marketing tools
- API access (REST and GraphQL)
The Service is part of the CMYK ecosystem, integrating with CYAN (analytics), YELO (content), and KEY (core infrastructure).
2. Account Terms
2.1 Account Creation
- You must provide a valid phone number for authentication
- You are responsible for maintaining the security of your account
- One person or legal entity may maintain no more than one free account
- You must be 16 years or older to use this Service
2.2 Account Security
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use
- We use OTP (One-Time Password) authentication via SMS for security
- You agree to keep your authentication methods secure
3. Acceptable Use Policy
3.1 Permitted Uses
You may use MAGENTA for:
- Legitimate business and personal projects
- Creating QR codes and smart links for legal content
- Tracking analytics for your own properties
- Automating workflows for productive purposes
- Building applications using our APIs
3.2 Prohibited Uses
You may NOT use MAGENTA to:
- Violate any laws or regulations
- Distribute malware, viruses, or harmful code
- Engage in phishing, fraud, or deceptive practices
- Harass, abuse, or harm another person
- Infringe on intellectual property rights
- Circumvent usage limits or security measures
- Scrape or harvest data without permission
- Interfere with or disrupt the Service
- Create competing services using our infrastructure
4. API Terms

4.1 API Guidelines
- Respect rate limits and implement exponential backoff
- Use appropriate authentication (API keys or OAuth)
- Cache responses when appropriate
- Include a User-Agent header with contact information
- Do not share API keys or credentials
5. Content and Intellectual Property
5.1 Your Content
You retain all rights to content you create using MAGENTA. By using our Service, you grant us a limited license to:
- Store and backup your content
- Display your content as part of the Service
- Process your content to provide Service features
5.2 Our Property
The MAGENTA platform, including its design, features, and documentation, is owned by Comma Connect, Inc. This includes but is not limited to:
- The MAGENTA brand and logos
- API design and documentation
- User interface and experience design
- Underlying source code and algorithms
5.3 Feedback
Any feedback, suggestions, or ideas you provide about MAGENTA become our property and may be used without compensation or attribution.
6. Privacy and Data Protection
Your use of MAGENTA is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Key points:
- We prioritize first-party data relationships
- Client data is completely isolated in our federated architecture
- We don't sell or share your personal data
- You maintain control over your data
7. Payment Terms
7.1 Free Tier
MAGENTA offers a generous free tier suitable for personal projects and small businesses. No credit card required.
7.2 Paid Services
For paid tiers:
- Billing is monthly or annual (with discount)
- Payments are non-refundable except as required by law
- Prices may change with 30 days notice
- Downgrades take effect at the next billing cycle
7.3 Overage Charges
Exceeding plan limits may result in:
- Automatic upgrade to the next tier
- Service throttling or temporary suspension
- Additional charges as specified in your plan

9. Disclaimers and Limitations
9.1 Service Provided "As Is"
MAGENTA is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free service
9.2 Limitation of Liability
10. Indemnification
You agree to indemnify and hold harmless Comma Connect, Inc., its affiliates, officers, agents, and employees from any claim, demand, or damage, including reasonable attorneys' fees, arising out of or related to your use of MAGENTA, your violation of these Terms, or your violation of any rights of another.
11. Termination
11.1 Your Right to Terminate
You may terminate your account at any time by:
- Requesting account deletion through the dashboard
- Contacting support@comma.cm
- Using the API deletion endpoint
11.2 Our Right to Terminate
We may terminate or suspend your account immediately, without prior notice, for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment of fees
- Prolonged inactivity (12+ months)
11.3 Effect of Termination
Upon termination:
- Your right to use MAGENTA ceases immediately
- We may delete your data after 30 days
- You remain liable for any outstanding charges
- Provisions that should survive termination will remain in effect
12. Dispute Resolution
12.1 Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting legal@comma.cm. We'll try to resolve the dispute informally by contacting you via email.
12.2 Arbitration
If we can't resolve the dispute informally, any dispute arising from these Terms shall be resolved through binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association.
12.3 Class Action Waiver
You agree to resolve disputes with us on an individual basis only, and not as part of a class, consolidated, or representative action.
13. General Provisions
13.1 Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
13.2 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Comma Connect, Inc. regarding MAGENTA.
13.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
13.4 No Waiver
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
13.5 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

By using MAGENTA, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
